UPDATE RE: MUNICIPAL AMENDMENTS OF THE UCC

Two important rulings received this week:
Carroll Valley Borough (Adams County)
The Adams County Court of Common Pleas has ruled in favor of the Borough and has rejected the complaints filed by the challengers.  This paves the way for the Borough to implement its adoption of Appendix B of the I-Fire Code and to also require sprinkler systems and holding tanks in new residential construction.

Schuylkill Twp. (Chester County)
The proposed ordinance to require fire suppression systems in most new buildings and in retrofits of existing building additions/alterations > 1000 SF had been challenged.  Following several hearings to consider the challenge, the Secretary of Labor and Industry has ruled in favor of the challengers and has voided the Department's prior approval of the proposed ordinance.

As a result of this ruling, the township may not enforce its ordinance.  The township may also appeal the decision of the Secretary to the Court of Common Pleas in Chester County.

Take note that Whitpain Twp., Montgomery County, is the first municipality to appeal the decision of the Secretary of Labor and Industry to the Court of Common Pleas.  A hearing was scheduled for June 9th, but a continuance was granted.  We will keep you posted on developments as they happen. Upon challenge, after initial approval of the Department that the proposed ordinance met the "equal to or more restrictive requirement" in the UCC amendment process, The Secretary ruled that unique and compelling circumstances did not exist in the township for the ordinance with the UCC amendment to stand.
